Two opposing groups within the Trinamool Congress (TMC) have sent different lists of leaders to the Election Commission of India (ECI). This has started a formal legal process to decide who officially controls the party's name, assets, and electoral symbol.

The current instability was caused by a major loss in the elections, where the Bharatiya Janata Party won 207 assembly seats compared to the TMC's 80. This led to a split in the party and the creation of a rebel group led by Ritabrata Banerjee. On June 19, 2026, this group held a meeting in Kolkata and voted to remove the founder, Mamata Banerjee, as chairperson, replacing her with Arup Roy. The rebel group claims there is a legal crisis because the term of the national working committee has ended. In contrast, Mamata Banerjee's group submitted their own list on June 20, 2026, to maintain her leadership, although they admitted their group is currently the minority.

Because of this, the Speaker has recognized 58 rebel members as the main opposition. At the same time, HDFC Bank has frozen approximately ₹676 crore in party accounts because both sides claim to be the authorized treasurer. Additionally, 20 members of the Lok Sabha have joined the Nationalist Citizens Party of India (NCPI) because they are unhappy with how Abhishek Banerjee manages the party.

The ECI will now use a legal method called the 'two-wing test' to solve the dispute. This means the Commission will check which group is stronger in both the party organization and the legislative wing. If the ECI decides that the number of legislators is the most important factor, the rebel group will likely keep the party's official name and the 'twin-flower' symbol. Consequently, the losing group would have to register as a new party with a temporary symbol.
