The parents of former professional athlete Doug Martin have started a federal lawsuit claiming wrongful death. The legal action is directed at the Oakland Police Department and the medical service provider, Falck Northern California.

The lawsuit was filed in the U.S. District Court for the Northern District of California following an incident on October 18. On that day, Mr. Martin suffered a mental health crisis. The family argues that officers used excessive force by holding Mr. Martin face down and putting pressure on his back. Furthermore, they claim that when officers noticed he was unresponsive, they wrongly assumed he was sleeping or pretending to be unconscious.

In addition to the police misconduct claims, the lawsuit highlights a failure in the emergency medical response. The plaintiffs emphasize that paramedics from Falck Northern California arrived about 15 minutes after being notified and failed to provide immediate care. Their lawyer, John Burris, stated that an independent medical expert believes the cause of death was likely restraint asphyxia. Additionally, the family has sent brain tissue to Boston University to check for chronic traumatic encephalopathy (CTE), although they acknowledge this would not change the primary cause of death.

Consequently, they are using the legal process to force the Alameda County coroner to release the official autopsy and toxicology reports.
