Section 702 of the Foreign Intelligence Surveillance Act (FISA) ended on Friday because the U.S. House of Representatives and the Senate could not agree on a way to extend the law before their break.

For example, there have been reports of FBI staff using the system incorrectly to search for information on domestic political events.

The failure to renew the law was caused by political disagreements and procedural problems. The House approved a three-year extension, but it included a ban on digital currencies from the Federal Reserve, which the Senate rejected. Furthermore, Democrats opposed the appointment of Bill Pulte as acting director of national intelligence, arguing that he lacked experience and might use surveillance tools for political reasons. Although President Trump later nominated Jay Clayton, who had more bipartisan support, the nomination happened after Congress had already adjourned.

Nevertheless, technology and telecommunications companies may stop cooperating with the government to avoid being sued, as they no longer have legal protection under the expired law. This risk cannot be fully solved by a presidential order.
