A West Australian couple has commenced legal action against Monash IVF alleging negligence and breach of contract after a mislabelled embryo resulted in the birth of a child not genetically linked to the donors.

The plaintiffs allege that Monash IVF failed to implement a secure identification system, resulting in the transfer of an incorrect embryo. This discrepancy remained undetected until February 2025, when the clinic identified a numerical deficit in another patient's embryo records, subsequently informing the recipient parents that the child was not biologically related to the West Australian donors.

While the organization has reached confidential settlements with other affected parties, the plaintiffs claim they were excluded from these arrangements.

The administration has characterized the errors as 'human error' and asserts that systemic enhancements have since been implemented to align with regulatory standards.
