A legal agreement has been reached between two sets of parents regarding the custody of a child born via a mistaken embryo implantation at a now-defunct Florida clinic.

The incident originated from services provided by IVF Life, Inc. (formerly the Fertility Center of Orlando) and its lead reproductive endocrinologist, Dr. Milton McNichol. Tiffany Score and Steven Mills contracted the facility for the cryogenic storage of three embryos; however, the implantation performed in March of the preceding year involved an embryo not genetically linked to the couple. Upon the birth of the child, Shea, in December, the plaintiffs noted a racial discrepancy, as the child displayed non-Caucasian physical characteristics. Subsequent genetic analysis confirmed the infant is of 100% South Asian descent.

Following the initiation of litigation in January, a search for the biological progenitors was conducted, resulting in the identification of the genetic parents, referred to in legal documentation as Patient 004. Despite the biological link, the genetic parents elected not to pursue a custody battle, citing the potential for protracted legal conflict and the perceived best interests of the child. Consequently, a mutually devised agreement was filed on June 12, designating Score and Mills as the permanent custodial parents. This rapprochement allows the biological parents to maintain a presence in the child's life while fostering a relationship of trust with the custodial parents.

Regarding institutional liability, the plaintiffs alleged that laboratory errors were systemic, necessitating genetic testing for all patients whose births resulted from the clinic's services over a five-year period. While IVF Life, Inc. previously stated it was cooperating with investigations to determine the source of the error, the facility has since ceased operations. The biological parents have indicated an intent to seek damages from the clinic and Dr. McNichol for the resulting circumstances.
